1. Introduction

365NCC LLC ("we," "us," or "our") operates the website 81learn.com and its AI-powered tutoring services under the brand name 81Learn (collectively, the "Service"). This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and what rights you have regarding your data.

By creating an account or using 81Learn, you agree to the practices described in this policy. If you do not agree, please do not use the Service.

2. Information We Collect

2.1 Information You Provide Directly

  • Email address — collected at registration, used to identify your account and send service-related communications.
  • Payment information — collected at checkout via PayPal, our payment processor. We do not store full credit card numbers; PayPal handles and vaults payment data on our behalf.
  • Account credentials — your username and a securely hashed password.

2.2 Information Generated When You Use the Service

  • Chat queries — the questions and prompts you type into the AI tutor agents are transmitted to OpenAI for real-time processing and to generate a response. 81Learn does not store the content of your chat messages. Queries are processed in real time and are not retained in our systems after a response is delivered.
  • Usage metrics — we log per-user token consumption counts (i.e., how many API tokens your sessions consume) for cost management and abuse prevention. These logs contain your account identifier and numeric usage figures, not the content of your conversations.
  • Session and authentication data — standard session cookies and authentication tokens to keep you logged in.

2.3 Information Collected Automatically

  • Log data — our hosting infrastructure automatically collects basic server logs, including IP address, browser type, referring URL, and pages visited, as is standard for any web server.
  • Cookies — see Section 11 (Cookies) for details.

2.4 Information We Do NOT Collect

  • We do not collect, store, or retain the content of chat conversations in our own databases.
  • We do not collect sensitive personal information such as Social Security numbers, government ID numbers, or precise geolocation.
  • We do not use advertising tracking technologies or sell personal data.

3. How We Use Your Information

OpenAI data retention note: As of the Effective Date of this policy, 81Learn has not enrolled in OpenAI's Zero Data Retention (ZDR) program. Under OpenAI's default API data usage policy, API inputs and outputs may be retained by OpenAI for up to 30 days for abuse monitoring purposes and are not used to train OpenAI models. We will update this policy if our OpenAI data handling configuration changes.

We do not authorize any of these providers to use your data for their own independent purposes beyond fulfilling services for us.

5. Children's Privacy / COPPA Compliance

81Learn is NOT directed at children under the age of 13.

We do not knowingly collect personal information from children under 13 without verifiable parental consent. Users under 13 should not create an account or use the Service without prior parental authorization through the process described below.

5.1 Parental Consent for Users Under 13

If a parent or legal guardian wishes to allow a child under 13 to use 81Learn, they must contact us at info@365NCC.com before the child registers. We will provide a parental consent form and, upon completion, set up the account in a manner consistent with the Children's Online Privacy Protection Act (COPPA).

5.2 If We Discover an Under-13 User Without Consent

If we learn that a child under 13 has registered without verifiable parental consent, we will:

  • Immediately suspend the account.
  • Delete the associated personal information (email, usage records).
  • Notify the email address on file that the account has been removed.

Parents who believe their child has created an account without consent should contact info@365NCC.com to request deletion.

5.3 FERPA Notice

81Learn is an educational tool designed to assist students preparing for AP and AICE examinations. To the extent FERPA (the Family Educational Rights and Privacy Act) applies to educational records you share with us, we handle that information consistent with FERPA's requirements. We do not share student data with third parties except as described in this policy. School districts requiring a Data Processing Agreement (DPA) before student use should contact us at info@365NCC.com prior to enrollment.

7. Your Rights

Depending on where you live, you may have the following rights regarding your personal data:

  • Access — request a copy of the personal information we hold about you.
  • Correction — ask us to correct inaccurate or incomplete information.
  • Deletion — request that we delete your personal data (subject to legal retention obligations).
  • Portability — request your data in a portable format.
  • Opt-out of sale — we do not sell personal data, so no opt-out is needed.

7.1 How to Submit a Request

Email info@365NCC.com with the subject line "Privacy Request" and describe what you are requesting. We will respond within 30 days (within 60 days for users protected by GDPR/UK GDPR if a complex request requires additional time).

7.2 California Residents (CCPA/CPRA)

California residents have additional rights under the California Consumer Privacy Act and its amendments. We do not sell or share personal information as defined under California law. To exercise your California rights, contact info@365NCC.com.

7.3 EU and UK Residents (GDPR / UK GDPR)

If you are located in the European Union or United Kingdom, you have rights under GDPR/UK GDPR including the right to lodge a complaint with your local data protection authority. Our lawful bases for processing are: performance of contract (account management, service delivery) and legitimate interest (security, cost monitoring).

8. Security

We implement reasonable technical and organizational safeguards to protect your information:

  • All data transmitted between your browser, 81learn.com, and the tutor application is encrypted via HTTPS/TLS.
  • Authentication cookies are set as HttpOnly and Secure, reducing exposure to client-side script attacks.
  • Chat content is never written to our databases — the most sensitive data you share never persists in our systems.
  • Access to usage data and administrative systems is restricted to authorized personnel.

No system is 100% secure. If you believe your account has been compromised, contact info@365NCC.com immediately.

9. International Users

81Learn is operated from the United States. If you access the Service from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country. By using the Service, you consent to this transfer. We apply the safeguards described in this policy regardless of where you are located.

10. Third-Party Links

81Learn may contain links to external websites (e.g., College Board, Cambridge Assessment International Education). We are not responsible for the privacy practices of those sites and encourage you to review their privacy policies independently.

11. Cookies

We use a minimal cookie footprint consistent with a subscription-based educational tool:

We do not use Google Analytics, Facebook Pixel, or any third-party advertising or retargeting cookies. You can clear cookies via your browser settings; doing so will log you out of your account.
